DukeToon respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on our platform infringes your copyright, please follow the procedure outlined below.

1. Copyright Respect and Compliance

DukeToon respects the intellectual property rights of others and takes matters of copyright very seriously. We strive to comply with copyright laws and address the needs of rights owners while providing a platform for users to share and enjoy various forms of digital content.

Our platform operates as a user-generated content service. We do not publish or distribute full, copyright-protected works; instead, users may post excerpts or fragments for personal, non-commercial use. Because we do not continuously monitor every piece of user-generated content, we rely on copyright owners to notify us of any potential infringements.

2. DMCA Takedown Procedure

If you believe that material accessible on DukeToon infringes your copyright or intellectual property rights, you may notify our Designated Agent pursuant to the Digital Millennium Copyright Act (DMCA). To be effective, your notice of claimed infringement must include the following information:

Required Information in Your DMCA Notice:

  • Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of Copyrighted Work: Clear identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, you may provide a representative list of such works.
  • Identification of Infringing Material: Identification of the material claimed to be infringing or the subject of infringing activity that you request us to remove or disable, and enough information (e.g., direct URLs or specific content descriptions) to permit us to locate the material.
  • Contact Information: Information reasonably sufficient to permit DukeToon to contact you, such as your name, address, telephone number, and email address.
  • Statement of Good Faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Statement of Accuracy: A statement under penalty of perjury that the information in your notification is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Important Guidelines

  • Be Specific: We do not accept links to search results alone, as they do not specifically identify the content to be removed. If you send a link to another page, please describe the specific content or fragment you believe is infringing.
  • Direct Links Preferred: Provide direct URLs to the specific infringing content to help us locate and review the material quickly.
  • Complete Information: Incomplete notices may delay our ability to process your claim. Please ensure all required information is included.
  • False Claims: Knowingly submitting false information in a DMCA notice can result in liability for damages, costs, and attorney fees.

4. Submitting Your DMCA Notice

5. Our Response

We will review your complaint in accordance with the DMCA and applicable laws. Upon receiving a valid DMCA notice that complies with all requirements, we will:

  • Act expeditiously to remove or disable access to the allegedly infringing material
  • Notify the content uploader of the takedown notice
  • Take appropriate action in accordance with the DMCA
  • Keep records of all notices for a period of at least 3 years for legal compliance purposes

6. Counter-Notice Procedure

If content has been removed or disabled due to a DMCA notice, and you believe it was removed in error or that you have the right to use the content, you may submit a counter-notice. A valid counter-notice must include:

  • Your physical or electronic signature
  • Identification of the removed content and the location where it appeared
  • A statement under penalty of perjury that you believe the content was removed in error
  • Your name, address, and telephone number
  • A statement that you consent to jurisdiction in the appropriate court

Counter-notices should be sent to the same email address as DMCA notices.

7. Policy on Repeated Infringement

In accordance with the DMCA and our Terms of Service, DukeToon will take appropriate action against users or content creators who repeatedly infringe upon the copyrights of others. Repeated infringement may result in account termination or other legal action.

8. Disclaimer

DukeToon is not responsible for evaluating the accuracy or validity of DMCA notices or counter-notices. We process notices in accordance with the DMCA. The submission of false information in a DMCA notice can expose you to significant civil and criminal liability.
